# 19 Months. Then an Investigation.

In February 2024, Israeli forces killed five-year-old Hind Rajab in Gaza. She was trapped in a vehicle with her slain relatives, pleading for help by phone to the Palestinian Red Crescent Society. Her final pleas were recorded and heard around the world. In [March 2025](https://www.npr.org/2026/08/20/nx-s1-5939310/israeli-military-criminal-probes?ref=diplopolis.com), Israeli forces fired on an ambulance driving to retrieve casualties in Rafah. They then fired on other emergency vehicles that came looking for the first. They killed 15 medics and emergency responders from the Red Crescent and Gaza's Civil Defense. Then they bulldozed the vehicles and bodies into a mass grave. It took UN and rescue workers a week to reach the site and dig them out.

On Wednesday, 19 months after Hind was killed and 17 months after the paramedics were buried, Israel's military announced its first criminal investigations into troop conduct in Gaza, covering both incidents. The military said it had completed reviews of 150 incidents and made decisions on five cases. Criminal investigations were opened on two of the five. The other three — including the killing of aid workers from World Central Kitchen and Doctors Without Borders — were reviewed and closed without criminal referrals. Chef José Andrés, who founded World Central Kitchen, called the decision not to investigate his colleagues' deaths 'wrong and painful.' The military did not elaborate on why those cases were closed.

The announcement's timing is specific in ways that are not difficult to read. In July 2024, United Nations independent experts wrote to the Israeli government demanding accountability for Hind's killing, saying the absence of investigation was deeply troubling and that the systematic nature of attacks on civilians may in itself amount to a violation of the right to life. That letter was written 13 months ago. No investigation was opened in response to it. On August 4, 2026, Trump confirmed on camera that the US campaign to dismantle the International Criminal Court was specifically intended to defend Netanyahu and other Israeli officials from prosecution. On August 19, 2026, Israel's military announced criminal investigations into two of the highest-profile killings in Gaza. Both events occurred in the same fortnight. The ICC — which has jurisdiction over exactly the conduct being investigated — is being demolished. The military investigation has been opened.

This is not coincidence. It is structural. DiploPolis wrote in August about the relationship between documented evidence and demolished courts: the bomb on a home in Qeshm was confirmed by the New York Times while the ICC was being dismantled by the US. The same relationship applies here. The killing of Hind Rajab was documented in real time — her voice, her phone calls, the satellite imagery of the site, the movements of the Israeli vehicles. The killing of the paramedics was documented by the sole survivor, by phone footage, by the physical evidence of the bulldozed mass grave. The ICC has jurisdiction over wilful killing of protected persons, intentional attacks on medical personnel and the use of prohibited methods of warfare. It is the precise court for precisely this evidence. It is being taken apart.

What the military investigation replaces is not the ICC. It replaces the ICC's credibility as a threat. A military that investigates itself has answered the accountability question in institutional terms: we are looking into it. The investigation does not produce an independent prosecutor, a warrant or a defendant. It produces a process controlled by the institution whose troops committed the acts being investigated. The Israeli military initially said it opened fire because the vehicles were 'advancing suspiciously.' The same military is now investigating whether its own explanation was true. The institution that produced the conduct is examining whether the conduct was appropriate. The court that would apply an external standard to that question is being dismantled on the other side of the world by the government providing the legal cover.

Hind Rajab's grandmother was photographed on August 19 in Gaza City, holding a photograph of her five-year-old granddaughter. The photograph was taken the same day the investigation was announced. She did not speak on camera. The investigation is internal. The court is being demolished. The photograph is what remains.
